1. Agreement to Terms
By engaging Aussie Comfort Homes for building, renovation, or construction services, you agree to be bound by these Terms and Conditions. These terms apply to all contracts, quotes, and agreements between you (the "Client") and Aussie Comfort Homes (the "Company").
If you do not agree with these terms, please do not proceed with our services.
2. Our Services
Aussie Comfort Homes provides the following services in Canberra and surrounding regions:
- New home construction
- Custom home builds
- Knockdown rebuild projects
- House and land packages
- Home renovations and extensions
- Granny flat construction
- Related building and construction services
All services are subject to availability, site conditions, and applicable regulations.
3. Quotes & Estimates
3.1 Quote Validity
Quotes provided by the Company are valid for 30 days from the date of issue, unless otherwise specified. Quotes may be subject to change based on material costs, labor rates, or site conditions.
3.2 Site Inspections
Accurate quotes require a thorough site inspection. Quotes provided without a site visit are estimates only and may be subject to revision.
3.3 Scope Changes
Any changes to the project scope after a quote is accepted will be subject to a variation quote and may affect the total contract price and timeline.
4. Contracts & Payments
4.1 Written Contracts
All projects require a written contract signed by both parties before work commences. The contract will detail the scope of work, pricing, payment schedule, and timeline.
4.2 Deposits
A deposit is required before work begins. The deposit amount will be specified in the contract and typically ranges from 10% to 30% of the total contract value.
4.3 Progress Payments
Payments are made in stages based on project milestones as outlined in the contract. Typical payment stages include:
- Deposit upon contract signing
- Base stage completion
- Frame stage completion
- Lock-up stage completion
- Fixing stage completion
- Practical completion
4.4 Payment Methods
Payments can be made via bank transfer, cheque, or credit card (surcharges may apply). All payments must be made within 7 days of invoice date unless otherwise agreed.
4.5 Late Payments
Late payments may result in work stoppage and/or interest charges at the rate of 2% per month on outstanding amounts.
5. Warranties
5.1 Structural Warranty
As a licensed builder (License No. 2016 137), we provide statutory warranties as required under ACT legislation, including:
- 7 years for major structural defects
- 2 years for non-structural defects
- Compliance with building codes and regulations
5.2 Workmanship Guarantee
We guarantee all workmanship for a period of 12 months from practical completion. This covers defects arising from faulty workmanship.
5.3 Materials Warranty
Materials are warranted according to the manufacturer's warranty terms. The Company will assist in warranty claims but is not responsible for manufacturer defects beyond our control.
5.4 Warranty Exclusions
Warranties do not cover:
- Normal wear and tear
- Damage from misuse or neglect
- Unauthorized modifications
- Acts of nature or force majeure
- Defects caused by Client-supplied materials
6. Liability & Insurance
6.1 Public Liability Insurance
The Company maintains public liability insurance as required by law. Insurance details are available upon request.
6.2 Limitation of Liability
The Company's liability is limited to the contract value or $10,000, whichever is greater, except for liabilities that cannot be excluded by law.
6.3 Client Responsibilities
The Client is responsible for:
- Ensuring clear site access
- Protecting personal property
- Maintaining existing home insurance
- Providing accurate site information
- Obtaining necessary approvals for works on their property
7. Privacy & Data Protection
We respect your privacy and handle personal information in accordance with Australian privacy laws. Information collected is used solely for providing our services and will not be shared with third parties without your consent, except as required by law.

8. Changes to Terms
The Company reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
For active contracts, changes will only apply to new agreements unless required by law.
